(ORAL) Instant writ petition has been filed for a direction to the respondents to constitute fresh wards of Nagar Panchayat Village Mehraj, Block Phool, District Bathinda, on the ground that there is variation in the list of voters in the wards. Learned counsel for the petitioners has been made aware that as per Rule 6 of the Delimitation of Wards of Municipalities Rules, 1972 delimitation of wards is carried out on the basis of population not on the basis of voters.

In view of this, learned counsel for the petitioners wants to withdraw this petition with liberty to file fresh one with regard to wrongful carving out of wards.
