(Oral) The petitioners are residents of village Salwan, Sub-Tehsil Ballah, District Karnal. They allege that some encroachments have been made on the village Pond (Johar) and no action is being taken by the authorities despite their complaint to the Director, Rural Development and Panchayat. It is alleged that an application was forwarded to Sub Divisional Officer (Civil), but no action has been taken so far. In our considered view, the petitioners have got an effective alternative remedy to initiate eviction proceedings against the alleged encroachers under Section 7 of the Punjab Village Common Lands (Regulation), Act, 1961 as applicable to the State of Haryana. It is directed that if any such petition is filed by the petitioners, the Assistant Collector, 1st Grade, shall decide the same expeditiously and in accordance with law.
