Petitioner has filed this third petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.135 dated 10.05.2017 under Sections 406, 120-B IPC (Section 420 IPC added later on), registered at Police Station Chandimandir, Panchkula.
I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that earlier two petitions for grant of anticipatory bail have already been dismissed on merit, one on 22.10.2017 and second on 14.01.2019, by passing detailed order by the Coordinate Bench. The petitioner has again filed this third petition for grant of anticipatory bail. No changed circumstance has been shown at the time of arguments. It is argued that petitioner has not committed any other offence VINEET GULATI 2019.08.26 15:27 I attest to the accuracy and authenticity of this document Chandigarh but in the order passed by the Coordinate Bench, it is mentioned that
CRM No.M-32945 of 2019 -2petitioner is involved in similar nature of cases. Keeping in view the facts and circumstances of the present case that this Court has already dismissed petitions for grant of anticipatory bail twice on merits and in view of the serious allegations against the petitioner and their being no changed circumstance for filing third petition, I do not find any ground to grant benefit of anticipatory bail to the petitioner. The filing of petitions one after the other and that too without changed circumstance shows that the petitioner, instead of surrendering before the police, is filing these frivolous petitions. Therefore, the present petition is dismissed with the costs of `25,000/- to be deposited with High Court Legal Services Committee within one month from today. If the amount is not deposited within the stipulated period, the Registry shall get it recovered as arrears of land revenue.
