The present petition has been filed under Section 528 of Bharatiya Nyaya Suraksha Sanhita, 2023 (for short-'BNSS') for quashing of order dated 13.05.2025 (Annexure P-3) passed by learned Special Judge, Fast Track Court, Fatehabad in case arising out of FIR No.142 dated 14.08.2018, under Section 224 IPC and Sections 21/27-A of the NDPS Act (Section 29 of the NDPS was added lateron), registered at Police Station Jakhal, District Fatehabad, whereby his bail was cancelled by learned trial Court, surety bonds were forfeited to the State and warrants of arrest were issued for 29.07.2025.

It is argued by learned counsel for the petitioner that on 13.05.2025, the petitioner reached the trial Court at a later stage as there was some break down in the bus in which he was travelling and found that his bail bonds were already cancelled and warrants of arrest were issued against him. Mr. Neeraj Poswal, learned AAG, Haryana accepts notice and submits that the present petition does not deserve to be allowed as the petitioner has intentionally absented himself. 5.

In view of the averments made in the petition and for the fact that the petitioner is ready and willing to join the proceedings before the trial Court, the present petition is disposed of with a direction to the petitioner to surrender before the trial Court on the date already fixed i.e. 29.07.2025 and on his surrender, he shall be admitted on bail by learned trial Court subject to his furnishing fresh personal/surety bonds to the satisfaction of the trial Court.
