In the present petition, on 09.06.2025, following order was passed by the coordinate Bench of this Court:- "

Apprehending arrest the petitioner has filed this petition under Section 482 of BNSS for grant of anticipatory bail in case bearing FIR No.185 dated 25.09.2021, under Sections 420, 467, 468, 471 IPC, registered at Police Station City Gurdaspur, District Gurdaspur. 2.

Learned counsel for the petitioner inter alia submits that the petitioner has been falsely implicated in this case on the basis of disclosure statement suffered by the co-accused-Vijay. Learned counsel submits that FIR was registered against three accused persons for submitting fake surety for the bail of the co-accused Ashwani Kumar. The petitioner was not named in the FIR. Neither he appeared as surety nor as witness for bail of the co-accused. The petitioner is ready to join the investigation and cooperate. 3.

Notice of motion.

At the asking of the Court, Mr. Adhiraj Singh Asst. A.G. Punjab, accepts notice on behalf of respondent-State and prays for time to file reply.

Adjourned to 18.07.2025.

Meanwhile, the petitioner is directed to join the investigation and appear before the investigating agency as and when called upon to do s In the event of his arrest, he shall be admitted to interim bail on his furnishing bail bonds to the satisfaction of the Arresting/Investigating Officer. The petitioner shall abide by the terms and conditions as envisaged under Section 438(2) Cr.P.C./482(2) of the BNSS, 2023." 2.

Learned counsel for the petitioner contends that in compliance of the order dated 09.06.2025, passed by this Court, the petitioner has JAWALA RAM 2025.07.21 19:54 I attest to the accuracy and authenticity of this document

CRM-M-31936-2025 - 2 - already joined the investigation and is ready to co-operate with investigation agency, as and when same is required again.

On the other hand, learned State counsel, also confirms the said statement of joining the investigation and thus, submits that the custodial interrogation of the petitioner is not required, at this stage, for the purpose of investigation.

Heard.

Since the petitioner has already joined the investigation and his custodial interrogation is not even asked for, present petition is allowed and the ad-interim order dated 09.06.2025 is hereby made absolute. However, petitioner shall continue to join the investigation as and when required to do so and abide by all the terms and conditions laid down under Section 482(2) of BNSS, 2023.

Besides, it is directed that petitioner would hand over his passport to the Investigating Agency or to Court concerned, if he possesses. Otherwise, would submit an affidavit, disclosing the fact that he does not possess any passport.

It is also directed that before leaving country any time during trial, petitioner would seek prior permission of the Court. 7.

Accordingly, petition stands disposed of.
