The petitioner through instant petition under Article 226 of the Constitution of India is seeking quashing of order dated 04.05.2026 passed by the State Registrar whereby members of Haryana Ex-Servicemen League (for short 'HESL') who are drawing salary from project work are made eligible to participate in the upcoming society's election. He is further seeking direction to respondents to remove names of paid employees of HESL from the voter list/Electoral Collegium of HESL and to restrain them from participating in the election process of the society. 2.

The petitioner is a member of HESL-Society registered under the Societies Registration Act, 1860 followed by re-registration under the provisions of the Haryana Registration and Regulation of Societies Act, 2012 (for short '2012 Act'). Several complaints qua irregularities and lack of transparency in the functioning of HESL were raised by members of the Society which led to filing of CWP-8869-2014 before this Hon'ble Court SUDEEPAK KUMAR 2026.05.29 17:33 I attest to the accuracy and integrity of this document

-2wherein vide order dated 09.05.2014 learned District Registrar, Rohtak was directed to decide their applications within two months. The District Registrar passed an order dated 07.07.2014 holding that district level funds/accounts maintained by Nodal Officers are funds/accounts of HESL and are amenable to statutory inspection under Section 20(3) of 2012 Act. Paid employees/Nodal Officers of the Society started participating in the elections of HESL and their names came to be included in the voter lists. Matter came to be brought in the knowledge of the District Registrar, Rohtak who vide order dated 28.01.2026 barred paid employees of the Society from participating in the elections and directed removal of their names from the voter list. Respondent No.6 being aggrieved preferred appeal before State Registrar, Haryana who vide impugned order dated 04.05.2026 has reversed the order dated 28.01.2026 thereby permitting the paid employees drawing salary from HESL to participate in the elections of the Society. 3.

Learned counsel for the petitioner seeks permission to withdraw the petition with liberty to file appeal before the Registrar General. 4.

Dismissed as withdrawn with aforesaid liberty. 5.

The Court is sanguine that if petitioner files appeal before the Registrar General, the said authority would endeavor to decide his appeal expeditiously.
