Rajan Gupta, J (Oral) Learned counsel for respondent No.5 points out that appeal preferred before the Commissioner, Roopnagar Division, Roopnagar has been allowed and case has been remanded to the Collector, Kharar for decision afresh after hearing the parties.

Learned counsel for the petitioner submits that he may be allowed to withdraw at this stage with liberty to file afresh if any cause of action arises.
