*** CRM-46765-2025 This is an application for quashing of order dated 09.09.2025 passed by this Court vide which presence of respondent was ordered to be procured through non-bailable warrants. On joint request of counsel for the parties, the main case is taken up today. CRM-A-1907-2019 Challenging the acquittal of the respondent, the State had filed the present leave to appeal along with an application for condonation of delay. On 06.12.2019, notice was issued in the application for condonation of delay. On 05.08.2022, fresh notice was issued to serve the respondent. Subsequently, on 10.05.2022, non-bailable warrants were issued. Vide order dated 09.09.2025, a Co-ordinate Division Bench of this Court issued fresh non-bailable warrants returnable for 09.12.2025. Vide the present application, counsel for the respondent submits that pursuant to non-bailable warrants, respondent has been arrested and put to custody. He submits that it is an appeal against acquittal and once there is an opinion of acquittal, there is no reason to keep him in custody pending State's appeal.

Counsel for the respondent further submits that he has no objection in case delay is condoned and appeal is admitted but the accused be released from jail and he undertakes to comply with all the orders and directions passed by this Court in the appeal. In the entirety of facts and circumstances of the case, respondent is ordered to be released on bail subject to furnishing personal bonds of Rs.25,000/- and surety of Rs.10,000/-. If the respondent is unable to furnish surety within one week, then he be released on personal bonds. The statement made on behalf of accused-respondent is accepted that he shall comply with the orders and directions of this Court. Leave to appeal granted.

The furnishing of the personal bonds shall be deemed acceptance of the all stipulations, terms, and conditions of this bail order.
