Petitioner has filed instant 2nd petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail in FIR No.185 dated 19.09.2024 under Sections 64 and 351 (2) of Bharatiya Nyaya Sanhita, 2023 (later-on added offence 64 (2) (M) of Bharatiya Nyaya Sanhita, 2023), registered at Police Station City Rupnagar, District Rupnagar. 2.
As per facts of the case, prosecutrix 'JK' gave her statement that she is 20 years old and was doing household work. Sikander is her relative with whom she got friendly three months ago. On 01.09.2024, Sikander came to her house at about 1 pm in the absence of her family members and
# committed forcible rape with her. He threatened not to disclose their relationship to anyone. Finally, she disclosed this fact to her mother and the matter was reported to the police.

Counsel for petitioner argued that Sikander was arrested in this case on 19.09.2024. Earlier, he had filed regular bail application bearing CRM-M-7945-2025 which was dismissed as withdrawn on 01.05.2025 (Annexure P-5). He filed another bail application before the trial Court which was also declined vide order dated 19.05.2025 (Annexure P-6). In the case in hand, statement of prosecutrix has been recorded as PW1 (Annexure P-2), statement of mother as PW2 (Annexure P-3), both the witnesses did not support the prosecution case. Their relationship was consensual. He is ready to abide by the terms and conditions of bail order. Therefore, his second regular bail petition may be allowed.

Learned counsel for respondent No.2 has not opposed the bail petition filed by the petitioner.

Status report is filed. After completion of investigation, challan was presented on 16.11.2024. Charges were framed on 29.01.2025. 13 Prosecution witnesses have been recorded out of 15 prosecution witnesses including the victim PW1, her mother PW2 and their statements are Annexure P2 and P3. Considering the gravity of offence, petitioner is not entitled for release on bail.

I have considered the aforesaid factual position. Material witnesses have been examined as referred above. Petitioner is behind the bars since 19.09.2024. Trial of this case may take some time. The evidence
