ARUN MONGA, J. (ORAL) This is the petitioner's second foray before this Court seeking anticipatory bail. The earlier petition was dismissed vide order dated 02.11.2020 on the ground that he did not join the investigation, notwithstanding, that he was granted interim concession to do the needful. 2.

Learned State counsel appearing in the earlier bail petition under instructions from a police Officer, made categorical statement that petitioner had not joined the investigation, basis whereof petition was dismissed. 3.

The second petition herein is filed on the ground that police Officer, who instructed qua non joining the investigation, was merely a briefing official and not the Investigating Officer.

On a query posed by this Court, learned State counsel submits that this time he has got written instructions from ASI Prem Singh, who is also the current Investigating Officer that despite opportunity, the petitioner has yet not joined the investigation.

In view thereof no grounds are made out to interfere. 6.

Dismissed.
