The petitioner incarcerated for violating the above-mentioned provisions of Narcotics Drugs and Psychotropic Substances Act, 1985 (NDPS Act) as per the FIR captioned above, has come up before this Court under Section 439 CrPC seeking bail. 2.

Notice served upon the official respondent(s) through the State counsel. 3.

Petitioner seeks bail on the grounds of prolonged custody and pre-trial incarceration.

On the other hand, State counsel on instructions from ASI Karamjit Mohan, submits that on the directions of this court, the trial is already on a very fast pace and the prosecution evidence is over and after recording statement of accused on 01.08.2023, the trial Court has adjourned the case for defence evidence for 21.08.2023. 5.

The trial Court is requested to complete the trial by 31.08.2023 if there is no other order of extension of time by this Court. It is further clarified that if the trial is delayed on part of the petitioner or at his instance or on his behalf, then the time lost due to such action, shall be deemed to have been extended beyond 31.08.2023. It is further clarified that if the trial is not concluded within the aforesaid period and the delay is not attributable to the petitioner, in that situation, it shall be permissible for the ANJU RANI 2023.08.04 14:39 I attest to the accuracy and integrity of this document
