Rakesh Kumar Jain, J. (oral) A post of Chowkidar in village Bhagwan in Tehsil and District Gurdaspur was created on 8.8.2002 under the orders of the Collector, Gurdaspur. In order to fill up the said post, Circle Revenue Officer invited applications on 4.9.2002 upto 20.9.2002. The petitioner as well as one Girdhari Lal applied for the said post. The petitioner was appointed by the SDM, Gurdaspur vide order dated 5.3.2004 (Annexure P-1) and his order was upheld by the Deputy Commissioner, Gurdaspur in appeal vide order dated 29.8.2006. However, the order of the Deputy Commissioner was set aside by the Commissioner and was upheld by the Financial Commissioner.
The petitioner has expired during the pendency of the present petition.

CWP-3687-2015 -2In view thereof, the present petition has abated because the cause of action to contest the present petition does not survive as it relates to the personal office which the petitioner had aquired.
