(ORAL) In the present writ petition, the challenge is to the order dated 14.11.2008 (Annexure P-3), by which the request of the petitioner for the grant of family pension after the death of her husband, who had rendered service with the respondents-department and had unfortunately died during service on 08.08.2002, has been rejected. Counsel for the petitioner states that while in service, husband of the petitioner had opted for the pension scheme, whereas counsel for the respondents is at pain to say that there is no record available with the respondents to verify that whether husband of the petitioner had opted for the pension scheme or not. CWP-4923-2014 -2Keeping in view the divergent stand taken by the parties, this writ petition involves several disputed questions of facts and the said facts cannot be ascertained by this Court in the writ jurisdiction. Faced with this situation, counsel for the petitioner states that petitioner be allowed to withdraw the present writ petition with a liberty to approach the appropriate forum/civil court for the redressal of her grievance in respect of the claim made in the present writ petition.
