G.S.SANDHAWALIA, J. (Oral) The petitioner seeks the benefit of Army service rendered by him from 28.05.1979 to 31.05.1996 and accordingly seeks consideration of his claim submitted through legal notice dated 11.01.2017 (Annexure P-7) for purposes of refixing the pay and providing him seniority/pay/salary/GP/ACP/Leave and other consequential benefits. Counsel for the petitioner submits that the petitioner had joined Indian Army on the post of Constable and subsequently qualified the course of Unit Education Instructor from 26.12.1983 to 31.03.1984 and thereafter was re-employed on the post of JBT in the Education Department on 18.11.2000. He is presently posted as JBT teacher at Government Primary School, Mandi Hariya, District Bhiwani, Haryana. It is further submitted that he will be satisfied if the said legal notice is decided by respondent no. 2 within a time bound frame.

Keeping in view the above, this Court is of the opinion that no useful purpose would be served to ask the respondents to file reply as the decision making process is still pending.

Accordingly, without commenting on the merits of the case or the entitlement of the petitioner for the abovesaid relief and keeping in view the fact that the matter is still pending consideration, the present writ petition is disposed of with a direction to respondent no. 2 to take a decision on the legal notice dated 11.01.2017 (Annexure P-7) within a period of 4 months from the date of receipt of certified copy of the order. In case any adverse order is to be passed, a reasoned order be passed and conveyed to the petitioner.
