The present petition has been filed by the petitioners under Articles 226/227 of the Constitution of India, seeking a writ of mandamus, directing the respondents to consider the claim of the petitioners for extending them the benefit of judgment of this Court in CWP No.15896 of 2023 titled as 'Saurabh Sharma and others v. State of Punjab and others', decided on 13.09.2024 (Annexure P-2) and grant them the benefit of regular pay scale of Rs.10300-34800+4200 G.P., as stipulated in the statutory rules namely Punjab State Elementary Education (Teaching Cadre) Group C Service Rules, 2018 dated 21.05.2018 as amended from time to time and also consider their claim for grant of full pay scale with all allowances to them during the period of their probation, and release all the due consequential benefits as per their entitlement from the due date till the date of actual benefits, along with interest on its delayed payment @ 12% per annum. 2.

CWP-17615-2026 -2redressal of their grievances, the petitioners have also served a legal notice dated 30.04.2026 (Annexure P-4) upon the respondents which is still pending consideration. He further submits that at this stage, the petitioners would be satisfied, if appropriate directions are issued to the respondents to consider and decide the said legal notice, by passing a speaking order, in a time bound manner.

On receipt of advance copy, Mr. Swapan Shorey, DAG, Punjab, accepts notice on behalf of the respondents. He has no objection to the innocuous prayer made by learned counsel for the petitioners.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.2 to decide the legal notice dated 30.04.2026 (Annexure P-4) served by the petitioners expeditiously, by passing a speaking order after affording an opportunity of hearing to them, preferably within a period of 04 months from the date of receipt of certified copy of this order.
