The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking setting aside of order dated 19.04.2024 (Annexure P-5) passed by District Consumer Disputes Redressal Commission (for short 'District Commission') whereby his execution application was dismissed and order dated 27.02.2025 (Annexure P-7) passed by State Consumers Dispute Redressal Commission (for short 'State Commission') whereby its appeal was also dismissed. 2.

Ms. Kavita Joshi, Advocate has appeared and filed Power of Attorney on behalf of the respondent. The same is taken on record. Registry is directed to tag the same at an appropriate place. 3.

The petitioner-Mill filed a complaint before the District Commission regarding conversion of the category from LS general industry to Bulk category which resulted into increase in tariff. The complaint was SUDEEPAK KUMAR 2026.05.29 17:33 I attest to the accuracy and integrity of this document

-2accepted vide order dated 29.04.2016. The respondent-authority filed appeal which was partly allowed. The respondent-Authority was held entitled to Rs. 10,31,879/- for the period from 14.08.2013 to 09.03.2015 and balance amount was ordered to be refunded to the petitioner. The petitioner filed execution which came to be dismissed vide order dated 19.04.2024. Appeal filed before State Commission has also been dismissed vide order dated 27.02.2025 on the ground of maintainability and limitation. 4.

On being confronted with Para Nos. 4 & 5 of order dated 19.04.2024 passed by the District Commission, learned Senior Advocate submits that grievance of petitioner survives with respect to period subsequent to August' 2015.

From the perusal of order dated 19.04.2024, it is evident that amount awarded by State Commission stands paid to the petitioner, thus, decree stands satisfied. The petitioner has independent cause with respect to the subsequent period and for the said purpose needs to avail separate remedy and cannot claim that there is infirmity in the orders passed by one or another authority.
