The petitioners have filed the instant petition under Articles 226/227 of the Constitution of India, seeking issuance of a writ of mandamus directing the respondents to re-fix the pay of the petitioner by stepping up the pay at par of his junior employee and to release the amount of difference of salary w.e.f. 01.01.2013 i.e. the date from which the junior employee was drawing more salary than the petitioner. Further, to grant all consequential benefits to the petitioner along with interest @ 18% per annum.

After arguing the case for sometime and realizing that this Court is not inclined to interfere in the matter as there is a considerable delay in approaching this Court as the petitioner stood retired from service on attaining the age of superannuation on 31.03.2023 and claiming stepping up of pay at par with his junior w.e.f. 01.01.2013 and of the fact that while he was in service, the said grievance was never raised by the petitioner, learned counsel for the petitioner wishes to withdraw the instant petition.
