Mr. Rajiv Vij, Addl. Public Prosecutor, U.T., Chandigarh. MEENAKSHI I. MEHTA (ORAL) By way of the instant petition, petitioner-Parveen Kumar seeks the indulgence of this Court for the issuance of a direction to respondents No.2 to 4 to provide adequate security cover to him and to protect his life and liberty as his elder brother had allegedly been murdered by and at the instance of the persons as described in legal notices/representations (Annexures P-4 and P-5) and the miscreants allegedly made an attempt on his life also which led to the registration of the FIR Annexure P-6. A further prayer to decide the said legal representation in a time bound manner has also been made. Notice of motion to the respondents.

Mr. Rajiv Vij, Addl. Public Prosecutor, U.T. Chandigarh has joined the proceedings in pursuance of the copy of this petition, having been sent to the respondents in advance and at the asking of the Court, he accepts notice on behalf of all the respondents.

A perusal of said representation/legal notice (Annexure P-5) reveals that besides the prayer for providing security cover to the petitioner and to protect his life and liberty, a prayer has also been made therein to investigate the matter thoroughly and to book the culprits at the earliest. However, learned counsel for the petitioner restricts his prayer to the issuance of a direction to respondent No.3-Senior Superintendent of Police, Chandigarh to take appropriate action on Annexure P-5 only to the extent of the said prayer for providing security cover to the petitioner and protecting his life and liberty. Learned counsel for the U.T. Chandigarh has no objection in giving the direction, restricted to the afore-discussed prayer, to respondent No.3.

Keeping in view the above-discussed facts and circumstances, the present petition is hereby disposed of with a limited direction to respondent No.3-Senior Superintendent of Police, Chandigarh to look into the legal notice/representation (Annexure P-5) so far as it pertains to the prayer made therein for providing adequate security cover to the petitioner and to protect his life and liberty only and if the said request of the petitioner is found to be genuine one, then to take appropriate action, in accordance with law.
