*** RAKESH KUMAR JAIN, J. (ORAL) The petitioner is seeking extension of parole on account his medical treatment.

The petitioner is presently lodged in District Jail, Faridkot, suffering sentence of 10 years in a case registered vide FIR No. 72 dated 04.09.2013 under Section 22 of the NDPS Act, 1985. As per the report of the Jail Hospital authorities, the petitioner is suffering from enlargement of liver and spleen, whereas, the petitioner has stated that he is suffering from Liver Cirrhosis and produced the report from the Fortis Hospital, Ludhiana. Although, it is not mentioned in the said report that the petitioner has to be admitted for the treatment but learned counsel for the petitioner has submitted that the petitioner will not get better treatment in the Jail Hospital. He has, thus, prayed for extension of parole for another two weeks. Learned counsel for the respondents has, however, submitted that since, the petitioner has already availed parole for 42 days i.e. 6 weeks w.e.f. 24.07.2018 to 05.09.2018, therefore, the same cannot be extended any further.

CWP No. 22353 of 2018 I have heard learned counsel for the parties and after examining the record, am of the considered opinion that in such case the petitioner is suffering from Liver Cirrhosis as has been observed by the Doctor attending to him at Fortis Hospital, Ludhiana, the petitioner deserves to be released for another two weeks for the purpose of his thorough check up and treatment. Thus, in view of the aforesaid facts and circumstances, the present petition is hereby allowed and extension of parole for two weeks is granted to the petitioner on the same bail bonds, furnished by the petitioner, at the time when parole was granted to him.
