(ORAL) Prayer in the present petition under Section 482 Cr.P.C. is for issuance of appropriate direction to the official respondents to consider the case of the petitioner and inquiry of both the FIRs i.e. FIR No. 79 dated 15.09.2021 registered under Sections 376-D, 506 IPC (Annexure P1) and FIR No. 82/21 registered under Sections 376-D and 506 IPC (Annexure P-3) at Police Station Bhindi Saidan, District Amritsar, be marked to officer not below the rank of IPS Officer, to further proceed in accordance with law.

Learned counsel for the State, on instructions, has informed this Court that in the case FIR No. 79 dated 15.09.2021 registered under Sections 376-D, 506 IPC, challan has been presented against the accused Goldy on 29.07.2023, and against the accused Gurmej on 07.11.2023; and charges have been framed on 15.11.2023 and 06.08.2024 respectively; out DIVYANSHI 2024.09.19 10:37 I attest to the accuracy and integrity of this document

CRM-M-43106-2021 (O&M) - 2of total 13 witnesses, none has been examined so far; and the next date fixed before the learned trial Court is 12.11.2024. It is submitted that the prosecutrix Rani has not come forward for recording her statement and as such, non-bailable warrants have been issued against her. It is further submitted that the petitioner-Beero has expired as is evident from order dated 06.08.2024 passed by learned Additional Sessions Judge, Fast Track Court, Amritsar. A copy of the said order is handed over in Court today, which is taken on record.

It is submitted that in FIR No. 82/21 registered under Sections 376-D and 506 IPC, there are total 3 accused and proclamation proceedings are underway against the accused No.2-Kulwant Singh. Challan has been presented against the remaining two accused i.e. Ravel Singh and Parghat Singh on 21.09.2023; charges have been framed on 09.11.2023; and out of total 14 witnesses, 2 stand examined; and the next date of hearing fixed before the learned trial Court is 23.10.2024. Learned proxy counsel for the petitioner does not dispute the above said facts.
