(Oral) The petitioner undoubtedly is a brilliant student and owing to his consistent performance, hard work, dedication and commitment, we have no reason to doubt that he shall achieve the desired heights. While the petitioner may have some grievance against evaluation and re-evaluation of his performance in the English paper but it is very difficult to doubt the procedure which the respondent-Board has apparently adopted while re-evaluating that paper. Similarly, there is a logic behind the Rule which does not permit reevaluation of a paper where the candidate has already secured 90% or above marks. The variation in assessment in the range of 10% is always attributable to the distinct human nature.
