(Oral) The petitioner claims that a residential plot was allotted to him under the 'Indira Awas Yojna' on 10.09.1991 within the revenue estate of village Behlolpur, Tehsil and District SAS Nagar Mohali. The possession was not delivered to him. He filed CWP No.16192 of 2013 which was disposed of by Division Bench of this Court vide order dated 29.07.2013 directing the B.D.P.O., Majri to look into the grievances of the petitioner in a time bound manner. The B.D.P.O., Majri has submitted a report to the Director, Rural Development and Panchayat Department, Punjab, concluding that at this stage no plot can be allotted to the petitioner.

The petitioner has also put up his counter-claim before the Director, Rural Development and Panchayat Department, Punjab by way of a legal notice dated 12.09.2014 (P-5) followed by some reminders.

CWP No.2963 of 2016 [2] As the facts would speak for themselves, the ball is in the court of the Director, Rural Development and Panchayat Department, Punjab who has to take a final decision as to whether or not the petitioner should be allotted a plot and if so, where and how to accommodate him.

We thus dispose of this writ petition without expressing any views on merits of the petitioner's claim with a direction to respondent No.2 to call for the records and determine the petitioner's claim on merits by way of a reasoned order, within a period of four months from the date of receiving a certified copy of this order.

Ordered accordingly.
