The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 to correct his date of birth in the passport.

The petitioner was issued passport on 29.01.2001 and it was valid upto 28.01.2011. In the passport, date of birth of the petitioner was recorded as 15.04.1965 whereas his correct date of birth is 07.02.1959. The petitioner is running from pillar to post to get his date of birth corrected in the passport. The petitioner vide representation dated 12.02.2022 requested the respondents to correct his date of birth in the passport. The petitioner filed application dated 21.06.2022 seeking fresh passport with correct date of birth. The petitioner had filed civil suit which has already been withdrawn.

Learned counsel for the petitioner inter alia contends that date of birth of the petitioner is 07.02.1959 whereas it has been wrongly recorded as 15.04.1965. The petitioner has to travel to USA and on account of incorrect date of birth recorded in passport, he is unable to get visa. All the documents of the petitioner are showing correct date of birth. The petitioner has applied for green card of USA and he is principal applicant on behalf of the family. No loss is going to be caused to the respondent, however, petitioner is facing protracted litigation to get his date of birth corrected in the passport.

Learned counsel for Union of India submits that verification of birth certificate is still pending, however, she submits that appropriate order would be passed within two weeks from today.

In view of the urgency and relief sought by the petitioner, it is expected that respondents would redress grievance of the petitioner within two weeks from today.

The petition stands disposed of.
