ARUN PALLI, J. (ORAL) The petitioners are praying for a direction to the respondents to re-fix their pay (step-up) equal to their junior counterparts w.e.f. 13.01.2006, i.e. the date of anomaly, when persons, who are alleged to be juniors to the petitioners, were awarded higher pay in terms of the Revised Pay Rules, 2008. The limited grievance that the petitioners have is that Smt. Sweena Rani, JBT teacher, posted at Government Primary School, Bhaini Majra, District Kaithal, who was appointed on 30.12.2004, and, thus, happen to be their junior, has been awarded higher pay. The matter in issue is alleged to be squarely covered by an order and judgment dated 15.05.2013, rendered by this Court in CWP No. 11254 of 2010 (Neelam Rani v. State of Haryana and others).

The petitioners purport to have repeatedly represented the respondents in this regard, but to no avail. Even the legal notice, dated 11.12.2017 (Annexure P-11), has failed to evoke any response. That being so, the petition is disposed of, at this stage, only with a direction to the respondents to consider and decide the claim as also the legal notice, dated 11.12.2017 (Annexure P-11), served upon the Prashant Kapoor 2018.02.

CWP-2250-2018 respondents, within a period of three months from the receipt of a certified copy of this order. And, pass appropriate orders in accordance with law. In the event, the claim of the petitioners is declined, the authority shall pass a comprehensive order assigning reasons in support thereof.
