(Oral) By way of present writ petition, petitioner is seeking quashing of impugned circular dated 06.01.2015 (P-4) whereby 75 D.P.E.S were called for counselling for transfer and appointment to the post of A.E.O in the offices of District Education Officers in the State ignoring the case of the petitioner for appointment to the post of A.E.O, despite being senior to respondent Nos. 3 and 4, who have been promoted.

On notice, a written statement has been filed on behalf of respondent Nos. 1 and 2 stating therein that as per seniority list, name of the petitioner was at Sr. 8610 and name of respondent Nos. 3 and 4 GAURAV ARORA 2016.03.03 14:24 I attest to the accuracy and integrity of this document

C.W.P No. 395 of 2015 -2were at Sr. NO. 4685 and 5304.1. Further it has been stated that Sukhbir Singh-respondent No 5 had foregone his promotion and further the seniority of petitioner and others was reviewed and in the revised seniority list as on 01.01.2012, the name of the petitioner has now been fixed at Sr. No. 5298A and Pardeep Kumar at Sr. No. 7814-A (R-II). Further it has been stated that none of the junior to the petitioner have been posted as AEO's. As and when further AEO's are posted/appointed, the name of the petitioner will be considered on the basis of his seniority No. 5298A.

In view of the above factual position, the writ petition stands disposed of with a direction to the respondents that in case further promotions are being made to the post of AEO's, the name of the petitioner be considered on the basis of his seniority No. 5298A.
