The short grievance of the petitioners is that they have filed statutory appeal against the eviction order dated 06.10.2015 which is now listed before the Appellate Authority on 14.01.2016. Meanwhile, warrant of possession has been issued on 29.12.2015 due to which they apprehend their dispossession.

Taking into consideration the above-stated circumstances and also in the light of the fact that the petitioners have a right to pursue their statutory remedy of appeal, we dispose of the writ petition without expressing any views on merits with a direction that status quo re: possession shall be maintained by the parties till the matter is decided by the Appellate Authority.

Let a copy of this order duly attested by the Bench Secretary be handed over to counsel for the petitioners during the course of day.
