MANJARI NEHRU KAUL, J. (ORAL) This is fifth petition filed by the petitioner seeking the concession of regular bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), in case FIR No.271 dated 16.08.2022 under Sections 21B, 29 of the NDPS Act, 1985, registered at Police Station Bhuna, District Fatehabad.

The third petition filed by the petitioner was dismissed on 31.05.2023 on merits. It is a matter of record that the petitioner is involved in as many as 16 criminal cases, which also includes six cases under Section 174-A of the IPC. It is evident that the petitioner, prima facie, comes across as a habitual offender and has been time and again absconding during the trial in various cases, which stand registered against him.

In the circumstances and more so when there is no material change in circumstances, no ground is made out to entertain the instant petition.
