(Oral) Prayer in the present petition under Section 528 of BNSS, 2023 for grant of transit anticipatory bail to the petitioners in case FIR No.11203040250018 dated 13.04.2025, registered with Women Police Station, Junagadh, Gujarat under Sections 85, 115(2), 352, 52 of BNS and under Section 3 of Dowry Act. 2.

Learned counsel for the petitioners submits that the instant FIR was registered by respondent No.5 against the present petitioners at Junagadh, Gujarat as a counterblast the earlier complaint filed by petitioner No.1 (husband of respondent No.5) against her. It is submitted that it is a clear case of false implication. The distance between the place of residence of the petitioners i.e. district Mohali and Junagadh, where the instant FIR has been registered, is more than 1450 Kms. As such it would take a considerable time for the petitioners to approach the Court of appropriate jurisdiction for the grant of anticipatory bail. CRM-M-32137-2025(O&M) - 2to enable the travel of the petitioners to Junagadh without any coercive action being taken against them. In this regard, reliance is placed on the judgment of the Hon'ble Supreme Court passed in Priya Indoria Vs. State of Karnataka and Ors. 2024 (2) RCR (Criminal) 112.

The instant case stemming out of a matrimonial dispute, learned State counsel does not oppose the plea of the petitioners seeking transit anticipatory bail.

In view of the foregoing, the petitioners are granted the relief of transit anticipatory bail for a period of three weeks from the date of this order, to facilitate the petitioners to approach the Court of competent jurisdiction for the grant of anticipatory bail in accordance with law. Needless to say that no coercive steps shall be taken against the petitioners during the period of three weeks. 5.
