Present petition has been filed by the petitioner under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'the BNSS') for setting aside the impugned order dated 04.05.2026 (Annexure P-3) passed by learned Additional Sessions Judge, Patiala, in FIR bearing No.63 dated 04.05.2018 (Annexure P-1), under Sections 307, 353, 186, 332 read with Section 34 of the Indian Penal Code, 1860 (for short 'the IPC'), registered at Police Station Shambhu, District Patiala, whereby, bail of the petitioner was cancelled and his bail/surety bonds were forfeited to the State and non-bailable warrants were issued qua him.

Learned counsel for the petitioner contended that the present FIR pertains to year 2018 and since then the petitioner was regularly appearing before learned trial court. However, on 04.05.2026, the petitioner noted down the wrong date and he failed to appear before learned trial court and, MANISHA 2026.05.30 12:47 I attest to the accuracy and integrity of this document

CRM-M-31461-2026 consequently, his bail was cancelled, bail/surety bonds were forfeited to State and non-bailable warrants were issued qua him. Learned counsel submitted that the petitioner is ready to surrender before learned trial court and prays that the petitioner be not arrested by the police till then. 3.

Notice of motion.

Mr. Anup Singh, AAG, Punjab, who is present in Court, accepted notice on behalf of respondent-State and submitted that the petitioner intentionally did not put in appearance before learned trial court and misused the concession of bail granted to him.

Petitioner is directed to surrender himself before the learned trial Court within a period of four weeks from today i.e. up to 26.06.2026, and to move an appropriate application before learned trial court by raising all the pleas taken in this petition, regarding his non-appearance. On his doing so, learned trial court shall decide his bail application expeditiously in accordance with law. Till then, he will not be arrested by the police in this matter. It is made clear that if he fails to appear before learned trial court within the stipulated period, then the relief granted by this Court shall be deemed to be withdrawn.

The petition stands disposed of accordingly.
