The petitioner was served with a charge-sheet dated 03.02.2014 (Annexure P-1), through which he was alleged to have committed certain acts of negligence and dereliction of duty.

On 28.03.2014, the petitioner had submitted a detailed reply to the charge-sheet, on which, according to the petitioner, till date no decision has been taken by the competent Authority. In the meanwhile, promotions have taken place and the case of the petitioner has been kept in a sealed cover. Thus, it is submitted by the counsel for the petitioner that the pendency of the disciplinary proceedings is acting to the prejudice of the MONIKA 2015.03.10 12:46 I attest to the accuracy and authenticity of this document

In view of the above, learned counsel for the petitioner submits that at this stage, he would be satisfied if a direction is issued to respondent no. 1 to consider the reply submitted by the petitioner to the charge-sheet served upon him and take a final decision thereupon whether to drop the charge-sheet or to proceed against him, in accordance with law. I find the request made by the counsel for the petitioner to be reasonable and accordingly issue directions to respondent no. 1 to consider the reply filed by the petitioner to the charge-sheet served upon him and after consideration of the same, take a decision thereupon either to drop the charge-sheet or to proceed against the petitioner, as per law. Needful be done by respondent no. 1 within two months from the date of receipt of a certified copy of this order. Petition is disposed of in the above terms.
