Baljit Singh v. State Of Punjab And Others
IN THE HIGH COURT OF PUNJAB & HARYANA AT
CHANDIGARH Date of decision: 30.04.2026 Baljit Singh
...Petitioner
Versus
State of Punjab and others
...Respondents
CORAM:
HON'BLE MS. JUSTICE MANDEEP PANNU Present :- Mr. Gurpyar Singh, Advocate for the petitioner.
Mr. Ritu Raj Singh, DAG, Punjab for respondents No.1 to 3.
***** MANDEEP PANNU, J. (Oral) 1.
The present petition has been filed by the petitioner under Section 482 of the Code of Criminal Procedure, 1973, seeking issuance of appropriate legal action against respondents No.4 to 7. 2.
It is averred in the petition that respondents No.4 to 7 have illegally detained the motorcycle bearing registration No. PB-13-BE-3875 belonging to the petitioner. It is further alleged that the said respondents have also taken into their possession the mobile phone of the petitioner, i.e Techno Spark-4 having two SIM cards, along with silver ornaments, important documents, a purse containing Rs.10,560/-, and the BSF uniform of the petitioner, without duly mentioning the same in the recovery memo pertaining to FIR No.190 dated 23.10.2020 registered under Section 295-A IPC at Police Station Ahmedgarh, as well as FIR No.201 dated 25.11.2020
-2registered under Sections 484, 485, 170 IPC and Section 6 of the Official Secrets Act, 1923. The petitioner has further prayed that appropriate directions be issued for taking legal action against respondents No.4 to 7 for their alleged illegal acts, for return/recovery of the aforesaid articles, and for ensuring that such actions are duly investigated in accordance with law. 4.
Per contra, learned State counsel has submitted that the allegations levelled by the petitioner are wholly false, baseless and devoid of merit. It is contended that the matter has already been thoroughly examined on several occasions pursuant to the complaints filed by the petitioner from time to time. Detailed enquiries were conducted by different enquiry officers, and in each such enquiry, the allegations regarding illegal detention of the motorcycle bearing No. PB-13-BE-3875, mobile phone (Techno Spark with two SIM cards), silver ornaments, purse containing Rs.10,560/- and important documents were found to be incorrect and unsubstantiated.
It is further submitted that the petitioner has been repeatedly making complaints on the same set of allegations with an oblique motive to pressurize the police officials associated with the investigation of FIR No.201 dated 25.11.2020 registered at Police Station Sadar Ahmedgarh. All such complaints have already been consigned after due enquiry. It is thus argued that no cause of action survives in favour of the petitioner and the present petition is nothing but an abuse of the process of law.
5.
Having heard learned counsel for the parties and perused the record, this Court finds that the issues raised in the present petition have already been the subject matter of multiple enquiries conducted by the competent authorities, wherein the allegations levelled by the petitioner
-3have consistently been found to be false and without any substance. The petitioner has failed to bring on record any fresh material so as to warrant interference by this Court in exercise of its inherent jurisdiction. 6.
In view of the submissions made by the learned State counsel and the material available on record, no ground is made out for issuance of any directions as prayed for in the present petition. 7.
Accordingly, the present petition stands disposed of. 8.
All pending applications, if any, also stand disposed of. (MANDEEP PANNU) 30.04.2026 JUDGE neetu Whether speaking/reasoned: Yes/No Whether Reportable:
