Pursuant to the previous order of this Court, an amount of Rs.62.32 lacs has been deposited, draw of lots held and possession letters issued. There is some dispute regarding the escalation component as the petitioners state that the requisite amount was not more than Rs.59.32 lacs. In this regard, the petitioners have also initiated proceedings before the Deputy Registrar, GHANSHYAM DASS 2016.01.29 14:57 I attest to the accuracy and authenticity of this document high court chandigarh

C.W.P. No.319 of2016 -2Cooperative Societies, Mohali, but since no officer had been assigned the charge of this functionary, the instant petition had been filed. However, during this interregnum, the Deputy Registrar, Cooperative Societies, Mohali has assumed his charge on 25.1.2016.

If that be so, then the proceedings which have been initiated before the said authority would need to be determined by him as the issues which have been raised in the instant petition are identical to the ones raised before him. The respondents would plead that they have serious objections to the report of the Committee which has been placed on record in this petition. I would not like to comment on this aspect for the simple reason that all these issues are open to debate before the Deputy Registrar, Cooperative Societies, Mohali before whom the proceedings have already been preferred. Learned counsel for the petitioners also states that in view of the availability of an alternative remedy before the Deputy Registrar, Cooperative Societies, Mohali, she would not press the instant petition, but confine her prayer to the limited extent that the said authority be directed to conclude the proceedings within a time bound period.

Finding this prayer to be reasonable, I accept the same and while disposing of the petition, direct the Deputy Registrar, Cooperative Societies, Mohali to enter upon the controversy and determine the same as expeditiously, as possible, preferably within a period of two months from the date of receipt of a certified copy of this order.
