**** H.S.Grewal, J. (Oral) Present petition has been filed under Article 226 of the Constitution of India for issuance of writ in the nature of Habeas Corpus for the release or produce the detenue namely Harjinder Kaur, wife of the petitioner from the illegal custody of respondent No.4. 2.
In compliance of order dated 06.06.2025, status report by way of an affidavit of Gurdeep Singh, Deputy Superintendent of Police, Sub Division Zira, District Ferozepur filed on behalf of respondents No.1 to 3 in Court today, is taken on record subject to all just exceptions. As per reply filed by the State counsel, the detenue Harjinder Kaur is living with respondent No.4 with her own sweet will. The statement of the detenue is reproduced as under:
"Stated that I am resident of the above mentioned address and is house hold lady. I have four children, out of which three are girls and one is son, whose ages are 10,8,6 and 4 years respectively. I had been sick for about 1-1/2 years and my family thought that I was affected by some external disease. Due to this, my husband as well as SONIA BURA 2025.06.12 14:26 I attest to the accuracy and integrity of this document
other family members provided me treatment from Sukha Baba, who visited our house twice. I feel better from his treatment and as such my husband Gurbhej Singh son of Gurcharan Singh who is running shop of boutique in the area of Ferozepur Cantt, used to took me to the shop and there also Sukha Baba started provided me treatment. When said Sukha Baba frequently visits the shop, then I also came in contact with said Sukha Baba. Thus my husband Gurbhej Singh started doubted on Sukha Baba and used to give me beatings. Thus on 24.05.2025, I left with said Baba from the house of my husband. On 26.05.2025, I filed living relationship petition in the Hon'ble High Court at Chandigarh. I am residing with Sukha son of Billa with my own sweet will. There is no pressure on me. Sukha Baba has not forcibly detained me with him. We have no danger from any one. We do not require any protection. I will also disclose the aforesaid facts by appearing in the court. The statement is written and the same is read over to me and is correct."
