The plaintiff-appellant is challenging the judgments and decrees passed by the Trial Court and the First Appellate Court whereby his civil suit and first appeal were dismissed.

Mr. Ferry Sofat, Advocate has appeared and has filed his memorandum of appearance on behalf of the respondents, which is taken on record. Learned counsel for the respondents states that the question of law involved in the present appeal as to whether jurisdiction of the Civil Court is barred in view of Section 145 of the Electricity Act, 2003 has since been decided by the Hon'ble Division Bench of this Court in RSA No.4181 of 2016 titled as 'Mahesh Kumar Versus Sub Divisional Officer & Anr.' vide judgment dated 14.05.2025.

Faced with the same, learned counsel for the plaintiff-appellant seeks permission to withdraw the present appeal as well as the civil suit itself with liberty to avail the remedies as available in law. 5.
Dismissed as withdrawn with the liberty aforesaid. 6.
It is made clear that any evidence recorded/observations made in the impugned judgments and decrees would not operate as res judicata in any subsequent proceedings initiated by the plaintiff-appellant. 7.
