**** HARNARESH SINGH GILL , J. (ORAL) The petitioner is seeking regular bail in FIR No. 415 dated 31.12.2011 under Sections 302, 201 IPC registered at Police Station Matlauda, Panipat.

Learned counsel for the petitioner submits that PW-2 Parkash son of Radhey Shyam in his cross-examination has stated that he had seen the accused (petitioner) for the first time in the Court whereas as per the prosecution case, the petitioner was the friend of the deceased. He further submits that the other witness namely Jitender has also not supported the prosecution version. The petitioner has been in custody since 2.11.2018 and has been entangled on the disclosure statement. Learned State counsel, on instructions from ASI Satvinder Singh, submits that out of 27 prosecution witnesses, 06 witnesses have been examined and the next date before the trial Court is 20.2.2020. CRM-M No. 34540 of 2019 -2prosecution witnesses, only six witnesses have been examined. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
