Mr. A.P. Kaushal, Advocate for the petitioner. RAKESH KUMAR JAIN, J (ORAL) The petitioner has come against the notice issued under Section 135 of the Electricity Act, 2003 (for short "the Act"), alleging that the notice is patently illegal.
I have heard learned counsel for the petitioner. There is remedy to challenge the notice in terms of Section 154 of the Act i.e before the Special Court, which is constituted under Section 153 of the Act.
Faced with this observation, learned counsel for the petitioner prays for withdrawal of the petition in order to avail the statutory remedy at the first instance against the issuance of notice under Section 135 of the Act.
