State of Haryana & Ors.
... Respondents **** CORAM: HON'BLE MR.JUSTICE SURYA KANT HON'BLE MR.JUSTICE P.B. BAJANTHRI ****
Present:
Mr. JP Sharma, Advocate for the petitioner **** SURYA KANT, J. (Oral) (1) The petitioner wants the nomination of respondent No.6 to be rejected on the ground that he is in unauthorized possession of shamlat deh land of the Gram Panchayat. (2) In our considered view, since the Gram Panchayat elections are scheduled to be held on 10.01.2016 and no time is left either for this Court or for the authorities to call for the record and determine eligibility of respondent No.6 to contest the ensuing election, we dispose of the writ petition with liberty to the petitioner to raise this plea in the Election Petition, if so advised. (3) Needless to say that the Election Tribunal shall be obligated to decide such petition expeditiously. (4) Ordered accordingly.
