Limited prayer made in the instant revision petition is for directing the Trial Court to decide the application filed by the petitioner-plaintiff under Order 39 Rule 1 and 2 read with Section 151 CPC, Annexure P-2. 2.

Mr. Ajay Jain, counsel for the petitioner submits that a suit, Annexure P1, along with the application for declaration and permanent injunction, Annexure P-2, was filed before the Trial Court. Notices were issued to the respondent/defendant, who appeared and filed a written statement contesting the suit. By making a reference to order dated 13.05.2025, Annexure P-5, he states that an application filed under Order 7 Rule 11 CPC by the defendant has been dismissed by the Trial Court and thereafter defendant filed an application dated 27.05.2025, Annexure P-8, for appointment of a Local Commissioner. He alleges that as the defendant is changing the nature of the land, it is imperative that the application, Annexure P-2, filed by the petitioner is decided expeditiously in a time bound manner.

Having heard counsel for the petitioner and considering the nature of prayer made by him, this Court does not deem it necessary to call upon the respondent.

As application for interim injunction filed by the petitioner is pending, instant revision petition is disposed of with a request to the Trial Court to decide it as expeditiously as possible preferably within a period of one month from the date of communication of a copy of this order.
