(Oral) Petitioner is seeking directions to the respondents to release the arrears of re-fixation of his pay amounting of `1,14,506/- along with interest for the period from 17.01.2006 to 10.10.2012. The respondents on notice filed the written statement and submitted that the total arrears payable to the petitioner for the period from 17.01.2006 to 11.10.2012, amounting to `1,14,517/-, were due from the Municipal Committee, Gharaunda. An amount of `1,03,066/- was paid to the petitioner after deducting TDS amounting to `11,451/-, vide cheque No.496291 dated 31.07.2015 and the same has been deposited by the petitioner, vide voucher dated 13.08.2015 (Annexure P-3/2). CWP No.4189 of 2015 (O&M) -2said amount of re-fixation has been paid in pursuant to the instructions dated 17.12.2012 (Annexure R-3/1), issued by the department, by which, the relaxation has been granted from passing a type test on being promoted from Class IV post to a Clerk.

Since, the payment of `1,03,066/- has been given to the petitioner after a period of three years, therefore, the present writ petition is disposed of with the direction to the respondent(s) to pay 9% interest on the said payment from December, 2012 till the payment is being made.
