Jaswant Singh,J(Oral) Four petitioners, on attaining age of superannuation, have retired with effect from different dates from the rank of Steno Typist/ Clerks. They were seeking promotion to the post of Senior Assistant with effect from 19.2.2010 i.e. the date when their Junior Jaswinder Pal Singhrespondent no.7 was promoted. Upon notice, in the written statement it was given out that the petitioners had been promoted with retrospective effect on notional basis. However, at the time of hearing today, learned counsel for the State submits that fresh order dated 2.12.2016 has been passed whereby the earlier order dated 13.3.2016 was modified to include the grant of benefit of promotion with all consequential benefits with retrospective effect. Copy of order dated 2.12.2016 is taken on record.

Learned counsel for the petitioners concedes that in view of the order dated 2.12.2016 the writ petition has become infructuous. Dismissed as having become infructuous.
