(Oral) The present petition has been filed for setting aside order dated 19.07.2019 passed by learned Civil Judge (Sr. Divn.) Balachaur. An application under Order 7 Rule 11 was moved by the defendant through his attorney Jaswant Singh allegation the suit of the plaintiff is barred and is liable tobe dismissed. However, the said application stands dismissed.
A bare perusal of impugned order shows that the application has rightly been dismissed as the suit is at the stage of finality. After availing five opportunities, the counsel for the defendant filed the above application just to delay the proceedings. Further it is a matter of evidence that whether any exchange deed took place between forefather of defendants and the alleged vendor of the plaintiff or whether there is relationship of landlord and tenant or whether defendant is mere tress passer. The revision petition stands dismissed being devoid of any merit.
