Petitioner has filed this petition under Article 226 of the Constitution of India seeking writ in the nature of mandamus directing the Presiding Officer, Industrial Tribunal, Amritsar to decide application (Annexure P-3) before proceeding further with the case.

Learned counsel for the petitioner has submitted that the Industrial Tribunal, Amritsar had no territorial jurisdiction to try the dispute. Petitioner had moved an application that an issue be framed in this regard before proceeding further with the matter. However, without deciding the application (Annexure P-3), Tribunal has framed issues on 02.12.2015 and the case has been adjourned for recording of the evidence of respondent No.2.

Accordingly this petition is disposed of with a direction to the Tribunal to dispose of the application moved by the petitioner (Annexure P-3), expeditiously in accordance with law, before proceeding to record the evidence of the parties.
