The prayer in the present petition under Section 483 BNSS, 2023 is for the grant of regular bail in case bearing FIR No.0151 dated 12.11.2025 registered under Sections 126(2), 109, 115(2), 118(1), 190, 191(3) of BNS, 2023 (Section 117(2), 118(2) and 238 BNS added later on) at Police Station Chhajali, District Sangrur.

The learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case. Taking the allegations to be correct, the injury attracting Section 118(2) BNS has been attributed to the petitioner on the right ankle of the complainant/Jagsir Singh. There is no opinion of any doctor regarding the invocation of Section 109 BNS. As the petitioner is in custody since 29.12.2025 but none of the 20 prosecution witnesses has been examined so far, the trial of the present case

CRM-M-31689-2026 -2is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail.

On the other hand, the learned State counsel contends that the allegations levelled against the petitioner are grave inasmuch as he has caused an injury on the right ankle of the complainant. Therefore, he is not entitled to the concession of bail. He, however concedes that the injury attracting Section 118(2) BNS has been attributed to the petitioner on the right ankle of the complainant, that he is in custody since 29.12.2025 and that none of the 20 prosecution witnesses has been examined so far. 4.

I have heard the learned counsel for the parties. 5.

The veracity of the prosecution case against the petitioner and his co-accused shall be adjudicated upon during the course of the Trial. Admittedly, the petitioner is in custody since 29.12.2025 but none of the 20 prosecution witnesses has been examined so far. Therefore, the Trial of the present case is not likely to be concluded anytime soon. In this situation the further incarceration of the petitioner is not required. 6.

Thus without commenting on the merits of the case, the present petition is allowed and petitioner-Manpreet Singh @ Peeta S/o S. Karnail Singh @ Karnail Singh Gamoliya is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned.

If the petitioner or his family members/associates make any attempt to contact/threaten/intimidate the witnesses in the present case, the

The petition stands disposed of.
