(Oral) The petitioner, on the pretext of challenging the election of respondent No.6 to the post of Sarpanch of village Kehrba, Tehsil Indri, District Karnal on the ground that the said respondent does not belong to the reserved category of Scheduled Caste, is actually questioning the very reservation of post of Sarpanch of his village for Scheduled Caste Category. In sum and substance, the petitioner's case is that his village Kehrba does not have the requisite population of Scheduled Castes so as to reserve the post of Sarpanch for that community.
In our considered view, such a contentious issue can be effectively gone into by the State Election Commission, Haryana in accordance with the scheme of the Statute and the Government notifications.
