NIDHI GUPTA, J. (ORAL) Prayer in this 2nd petition filed under Section 439 Cr.P.C., is for grant of regular bail to the petitioner in case FIR No. 91 dated 22.12.2022 (Annexure P-1) registered under Sections 363 and 366 IPC {Sections 376A, 302, 201, 120-B, 34 IPC and Sections 6 and 17 of the Protection of Children from Sexual Offences Act, 2012, added later on} at Police Station City Kurali, District SAS Nagar (Mohali), Punjab. Learned counsel for the State has filed custody certificate dated 30.07.2024 which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 01 year, 07 months and 03 days.

After arguing for some time, when this Court is not inclined to accord the benefit of regular bail to the petitioner, learned counsel submits that he may be permitted to withdraw the instant petition, at this stage.

Permitted to do so.

Dismissed as withdrawn, at this stage.
