3. Whether the judgment should be reported in the Digest? --- Surya Kant, J. (Oral) The petitioner is a resident of village Ranjit Nagar (Seona), Tehsil & District Patiala. He seeks a mandamus to direct the official-respondents to remove the unauthorized possession of respondent Nos.8 & 9 from the shamlat land comprising khasra Nos.549 (4-16), 549/1 (1-4), 549 min (26-5) situated within the revenue estate of his village. The petitioner alleges that pursuant to the directions earlier issued by this Court, respondent Nos.8 & 9 were evicted from the Gram Panchayat land but they have again entered into illegal possession of the Gram Panchayat land in collusion with the Gram Panchayat. The petitioner brought this fact to the notice the authorities and it appears from one of the communication dated 06.11.2015 (P-9) that the Block Development and Panchayat Officer, Patiala asked respondent Nos.8 & 9 to show cause as to why their illegal possession be not removed. CWP No.3420 of 2016 [2] However, no action is said to have been taken thereafter. Having regard to the above-stated plea taken by the petitioner coupled with the documents on record but without expressing any views on merits of the allegations more-so when we have not heard the respondents at this stage, the instant writ petition is disposed of with a direction to the DDPO-Cum-Collector, Patiala to hold a fact-finding enquiry and take necessary remedial action for restoration of the Gram Panchayat land in accordance with law. The needful shall be done within a period of six months from the date of receiving a certified copy of this order.
