*** The case has been taken up through Video Conferencing. Petitioner Rinku Ram, an employee of Punjab State Power Corporation Limited, Patiala working as a Clerk is presently posted in the office of Resident Engineer, Shanon Power House, Joginder Nagar, District Mandi, Himachal Pradesh since 29.9.2016 i.e. for a period of more than five years. According to him he should have been transferred from the present place of his posting in terms of instructions, rules and guidelines but has not been so done. He has also submitted that a transfer order dated 28.6.2021 has been issued transferring him form the present place of posting to B.B.M.B, Chandigarh but that is not being implemented; he had submitted a legal notice dated 1.9.2021 (Annexure P-5) but that has not evoked any response necessitating the filing of the present writ petition.
While filing the present writ petition seeking implementation of the transfer order, the petitioner in alternative has sought issuance of direction to respondent No. 1 PARVINDER SINGH 2021.10.
CWP No. 20755 of 2021 to decide the legal notice as per rules.
Keeping in view the nature of the dispute between the parties as well as prayer made by the petitioner, for the purpose of enabling respondent No. 1 to consider and dispose of the legal notice and then to take appropriate action, if need be and further to avoid unnecessary litigation, the writ petition is disposed of directing respondent No. 1 to consider and dispose of the legal notice of the petitioner in accordance with law, rules, regulations and instructions on the subject within a period of two months from the date of receipt of copy of the order and if some action in the matter is warranted then the needful be done in accordance with law. A speaking order in that regard be passed, which be conveyed to the petitioner. If the petitioner feels dissatisfied after passing of the order then he may approach the Court again in accordance with law.
