**** RITU BAHRI , J. (Oral) The precise grievance of the petitioner is that he retired from the post of U.D.C on 30.11.2014 and he was released pension on 03.08.2015. Out of gratuity amount of Rs.9,98,897/-, petitioner was released only an amount of Rs.3,47,000/- on 28.09.2015 and thus an amount of Rs.6,51,653/- is lying with the department. Further the pension of the petitioner has been fixed without giving him the benefit of 3rd ACP, as the petitioner was promoted to the post of UDC in February 2013.

Petitioner has served representations and legal notices (P-4 to P-7) in this regard but till date no action has been taken by the respondents. Further no departmental enquiry is pending against the GAURAV ARORA 2016.02.29 10:46 I attest to the accuracy and integrity of this document

Learned counsel for the petitioners states, that at this stage, the petitioners will be satisfied, if directions are issued to respondents to decide the representations/legal notices, referred to above. In view of above, without commenting on the merits of the case, this petition is disposed of with a direction to the respondents to decide the representations/legal notices (P-4 to P-7) of the petitioner by passing a speaking order expeditiously, in accordance with law, within a period of three month's and thereafter, a compliance report be sent to this Court.
