Jaswant Singh,J.(Oral) The residents of Village Zarifabad, Tehsil and District Karnal are simply seeking a mandamus for directing the official respondents to initiate appropriate proceedings against Sultan Singh/ Sarpanch-respondent no.8 of Village Zarifabad,Tehsil and District Karnal for his illegal acts relating to the functioning of his office. Upon notice, respondents were asked to furnish information as to what action was proposed against the Sarpanch of Village Zarifabad for his illegal acts and misuse of his office. Since the required information had not come forth till the last date of hearing i.e. 20.5.2015, this Court was constrained to summon Director General,Panchayats and Deputy Commissioner, Karnal. CWP 4289/2015 Development and Panchayat,Haryana and Mr.J.Ganeshan, DC Karnal are present in Court and have offered their explanation regarding nonfurnishing of the information which appears to be bona fide. It is further stated that disciplinary action is being taken against BDPO, and Panchayat Secretary concerned. The explanation furnished is accepted. It is further stated that a regular enquiry under Section 51 of the Haryana Panchayati Raj Act,1994 has been initiated, although at this stage no case for suspension is made out. It is further assured that the said enquiry will be completed within one month. In response, learned counsel for the petitioner in the light of aforesaid actions taken, states that nothing survives in the petition for further adjudication in the matter.
In view of the aforesaid stand, present writ petition is dismissed as infructuous. Respondents shall be bound by statement made before the Court.
