RAJESH BHARDWAJ, J.(ORAL) Instant petition has been filed under Section 482 Cr.P.C. praying for quashing of FIR No.18 dated 18.04.2017, under Sections 377, 511 IPC, registered at Police Station Kanwan, District Pathankot and all other consequential proceedings arising therefrom on the basis of compromise.

It has been contended by counsel for the petitioner that petitioner before this Court is a juvenile and there were vague allegations in the FIR. He submits that with the intervention of respectables both the sides have amicably resolved the issue and decided not to pursue the proceedings in the FIR and thus, prosecution of the petitioner would be nothing but an abuse of the process of the Court.

Ms.Deepti Rampal, Advocate, who is present in Court, accepts notice on behalf of respondents no.2 and 3 and affirms the submission made by counsel for the petitioner.

CRM-M-38591-2022 -22023:PHHC:058135 On asking of the Court, Mr.Sandeep Kumar, DAG, Punjab, who is present in Court, accepts notice on behalf of respondent no.1/State and on instructions from ASI Surinder Singh, has submitted that after investigation cancellation was prepared on 24.06.2017 and subsequently filed in the Court, however, the same was returned by the trial Court on 06.11.2020 for further investigation and the same is pending for investigation. In view of the statement made by learned State counsel, the present petition is disposed of with a direction to respondent/Investigating Agency to complete the investigation within a period of two week from today. The parties are at liberty to pursue their remedies before the Court concerned.
